Terms of Service

The rules for using CargoIT. They form a contract between your company and the operator of this platform, so they are worth the ten minutes.

01Who operates CargoIT

CargoIT is operated by Maria Petrova, a private individual established in Bulgaria, at Elenovo 176, 2700 Blagoevgrad, Bulgaria. There is no company behind the platform at present, and no company registration or VAT number to give. You can reach us at [email protected].

In these terms, "we", "us" and "the platform" mean that person. "You" means the business that holds the account, and anyone using the account on its behalf.

02These terms are for businesses

CargoIT is a service for registered businesses only. You may not open an account as a consumer, and by registering you confirm that you are acting for a business in the course of its trade. Consumer protection rules, including any right to withdraw from a distance contract, do not apply.

Registration requires a valid VAT number, which is how the platform enforces this.

03What CargoIT is — and what it is not

CargoIT is a marketplace. We are not a carrier, a freight forwarder, a broker, or a party to any transport contract agreed through the platform. We do not carry freight, arrange carriage, take possession of cargo, or assume liability for it under the CMR Convention or any other transport regime.

When a shipper accepts a carrier's request, a contract is formed directly between those two companies, on the terms they have agreed between themselves. The platform records that agreement and shows both sides what was agreed. It does not guarantee that either of them will perform it.

Everything that follows from the haul itself — the freight, its condition, delays, damage, loss, payment of the agreed price, customs, permits, insurance claims — is a matter between the two companies. If something goes wrong with a load, your counterparty is the carrier or the shipper, not us.

04Opening an account

To use the platform you register a user, confirm your email address, and submit your company for review. Your company must be a real, registered business, and the details you give us — name, VAT number, address, phone — must be accurate and kept up to date.

One company per account for now. You are responsible for keeping your password secure and for everything done through your account. Tell us promptly at [email protected] if you believe someone else has access to it.

05What our review does and does not check

Before a company can post loads or make offers, an administrator reviews it. That review is an administrative check of the details you submitted and whether they look consistent and plausible.

It is not a verification of your counterparty's transport licence, insurance cover, financial standing, operational capability, or fitness to carry any particular freight. Approval on CargoIT means a company passed our check. It is not a recommendation, a guarantee, or a substitute for your own due diligence.

Do your own checks before you hand anyone your freight or accept anyone's load. We may refuse, suspend or remove any company at our discretion, and we are not obliged to explain a commercial decision in detail.

06Posting a load

If you post a load, you confirm that the details are accurate and complete — the goods, weight, dimensions, loading and delivery points, dates, and anything a carrier would need to know to price and plan the haul. Inaccurate listings waste other businesses' time and money, and are grounds for removal.

You may not post, or seek carriage for:

  • weapons, ammunition, explosives, or their components;
  • narcotics or controlled substances;
  • counterfeit, stolen or illegally traded goods;
  • live animals, human remains, or anything requiring specialist handling you have not disclosed;
  • dangerous goods, unless the load says so and the carriage complies with ADR;
  • anything whose carriage requires a licence, permit or authorisation that you or the carrier does not hold.

You are also responsible for compliance with sanctions and export control law. You may not use CargoIT to arrange carriage to, from or through a sanctioned territory, for a sanctioned person or entity, or of goods whose export is restricted, in breach of EU or applicable national law. This matters more on European road freight than people expect, and it is your obligation, not ours.

Every load is reviewed before it reaches the carrier pool. We may reject, edit or remove any listing, and we may re-review a load you have edited.

07Offers, bookings and prices

A carrier may request a load and propose a price. A shipper may accept one request, which ends the others. Acceptance forms the transport contract described in clause 3.

Prices, payment terms, payment itself, invoicing and any dispute about money are entirely between the two companies. The platform handles no payments and provides no escrow, no payment guarantee, no credit check and no insurance. Nothing on CargoIT should be read as an assurance that your counterparty can or will pay.

08Contact details are for the haul

The platform releases a company's address, phone number and the email address of its owner only when there is a reason for it: to the shipper of a load, to the carrier whose request that shipper accepted, and to our administrators. It is deliberately not possible to browse other companies' contact details.

When you receive another company's contact details through CargoIT, you may use them for that shipment only. You may not use them for marketing, add them to a mailing list, sell or share them, or build a database from them. Doing so is a breach of these terms, and — since these are personal data — is very likely a breach of data protection law as well.

09Statuses, distances and other figures

Shipment statuses are recorded by the two companies themselves. When a carrier marks a load as loaded, or a shipper marks it delivered, that is their statement, not our confirmation that anything physically happened. We do not track vehicles.

Road distances and driving times shown on a load are estimates calculated from map data. The driving time is free-flow drive time for a heavy goods vehicle — it is not an estimated time of arrival. It excludes loading, traffic, rest periods, border waiting and everything else that decides when a truck actually arrives. Do not price a lane or promise a delivery window on the strength of it.

Some loads carry no distance at all. That means we could not measure the lane, not that it is short.

10Availability

We aim to keep CargoIT available and working, but we do not promise any particular level of service. The platform may be unavailable for maintenance, may change, and may have features added or removed. We will try to give notice of anything significant, but we may act without notice where we need to.

11Content and intellectual property

The platform — its software, design, text and branding — belongs to us, and nothing in these terms transfers any of it to you.

What you put into CargoIT stays yours. By posting it, you give us the permission we need to run the service: to store it, show it to the other businesses it is meant for, and include it in the records described in our Privacy Notice.

12How you may use the platform

You may not:

  • scrape, crawl or bulk-extract listings, companies or contact details;
  • share your account, or let a company we have not approved use it;
  • post a load you do not have, or make an offer you cannot perform, in order to obtain contact details or market intelligence;
  • attempt to access another company's data, interfere with the service, or probe it for weaknesses without our written agreement;
  • use the platform to break the law.

13Liability

CargoIT is provided as it is. To the extent the law allows, we exclude liability for indirect and consequential loss, including lost profit, lost business, lost freight, and losses arising from a counterparty's acts, omissions, insolvency or non-performance.

Nothing here excludes or limits liability that cannot be excluded or limited under the law of Bulgaria — including liability for intent, for death or personal injury, and anything else the law reserves.

Read together with clause 3: because we are not a party to the transport contract, a claim about the freight itself lies against your counterparty.

14Suspension, termination and shipments in progress

You may close your account at any time. We may suspend or terminate an account that breaches these terms, that we believe is being used fraudulently, or where we are required to.

Closing an account does not end a transport contract already agreed through the platform. If a shipment is in progress, it remains a contract between the two companies, and both are expected to complete it — losing access to CargoIT is not a reason to abandon a load someone is waiting for.

15Changes to these terms

We may change these terms as the platform develops. The version and date at the top of this page say which version you are reading. If a change is significant we will tell you — by email or in the app — and give you a chance to read it before it takes effect. Continuing to use CargoIT after that means you accept the new version. If you do not, you may close your account.

16Law, disputes and language

These terms are governed by the law of Bulgaria, and the courts of Bulgaria have jurisdiction over any dispute about them. This says nothing about the law governing a transport contract between two companies, which is for them to agree.

The English version of these terms is authoritative. Any translation, including the Bulgarian one, is provided for convenience only. If they differ, the English text applies.
